This is my first investor. I would like to know if anyone knows IF AND HOW to obtain the CCR before purchase or before putting in a contract. I want my investors to know if there have been any litigation with the developer. I want them to know about the associations finances. Can we review the budget? Can we talk to the association president? How do I obtain that info?

I'm assuming you're a new agent...

ASK the listing agent for a copy of the CC&Rs.

If they don't have one, call other agents who have listings in the complex.

If that doesn't work, call a title company you are friendly with.

The homeowner should have the minutes from the HOA meetings, an operating statement, 20 year repair cost plan, budget, etc. Just ask, many times they have it all bundled up. If not, find out who manages the HOA, & call them.

The biggest question to ask is do they even allow rentals or to hold as investments?

Some condo associations have bylaws that prevent investors from purchasing and renting out.

The reason they put this in there is they want to approve usually every new owner and feel renters will bring down values in the development.Check that first before you go any further.
