I closed on a property which I owned last week. It's under government housing & tenant first agreed in writing to move on or before the 26th of the month. Then verbally she said the 15th, we closed thinking she was leaving the 15th well she did not so we went back to the original agreement of Dec.26. The buyers agreed but now she is saying she is not sure if she will leave the 26th because she has no where to go! My DH told her we have given her enough time (since Oct. she knew property was being sold). I am a license realtor and I am very concerned. My DH told her she has to vacate on the 26th but then she told the new owner that she was not sure if she was. I am so nervous about the whole thing. I am thinking of going to the government housing office tomorrow w/the paper she signed for the 26th. Any suggestions. She is under section8 government housing.
Thanks, I am about to have a breakdown.

Your post is very confusing and unclear.

So you sold a property that you owned last week?Why didn't she vacate before the closing?What does the lease agreement say?Who is DH?So if you already sold the property the buyer now owns it?
Is the buyer an investor or do they want to live in the property?

I know this sounds bad but if you closed on it isnt the lease transferred? I would think it is now the new owners to deal with. Id suggest starting the eviction process immediately if you plan to get her out.

Sorry if I did not make myself clear. She is not on a lease, government housing said once the owner decides to sell tenant has to vacate. So even if you receive your payment from the government for the full month & you & your tenant come upon an agreement when to vacate they dont care of the date. I will be going to the government housing tomorrow & see what they suggest. Maybe I am just stressing myself out too much, I am a newby. I will let you know what else I come up with. Any suggestions are greatly appreciated.

If you're desperate for suggestions, here's one. Do you have connections to help her find a new place to live? Many times people are so busy working, or just trying to keep their head above water, they don't know how to go about finding a new place to live. I know it's not your fault, and you've certainly given her enough time, but if you could solicit a place for her to move to, she might happily leave.

You could try an ad in Craig's list. Doesn't cost anything and you can have section 8 landlords call you. "Please help, desperate for housing".

Section 8 Housing Authority does not offer property management assistance of any kind. I hope you had your tenant served with a 90 day notice .... 90 days ago. If not, you have problems. If yes and she still isn't moving, eviction is the only way to get her out. As suggested earlier, perhaps you can help her to find alternate housing? Perhaps she can continue to pay rent to the buyer while actively looking for somewhere else to live? You did drop the ball on this one - you should've had the tenant served with a 90 day, all the while communicating with her as to what she was actually doing with regard to moving out and stressing that she would have a public eviction notice on her record if you were forced to file for unlawful detainer. If nothing else, the rent must still be paid - are Section 8 paying their share? If a 90 day was served and has expired now, Section 8 will stop paying altogether because a new contract is needed. Make sure you get a lawyer who is experienced with the eviction process.

Thank you for all your suggestions. She finally left yesterday! She left because the new owner came by on the 26th (which was the agreed date for her to leave) and told her he was bringing his things in. She had nothing ready so he suggested to help her move & that is how she got out. I was so upset, they practically had to push her out because she had no plans of leaving. Well at least I feel much better now that everything was taken care of. Yes, I did speak to section8 & they said the same thing that they don't get involved in landlord/tenant issues only that if she would get avicted that she would be out of the program. Well I have learned a good lesson never close a deal before tenant is out!
