WOW I think I smell a large class action lawsuit Lets see Broker hires agents,agents get PAS REO acounts Brokers RELO department smells cash becouse relo market is kaput and uses agents contacts and experience to solicit and procure contracts with PAS wherin relo takes part of commision. All Pas agents with company are terminated with PAS. RUN RUN Run to your CAR free legal line and get a Class action suit going against both PRU and PAS LMAO. I even heard from one agent that was called by relo for contact info about reos and relo was way pissed he wouldnt give up his REO clients. Also was told relo called his asset managers for info thats way they have email info on there inhouse form. Boy gives me the warm and fuzzy feeling to think of working for them. Whats next they solicit your individual clients for a cheaper commision. When you leave PRU I heard RE/MAX isnt much better.

Hmmm. I'm not certain if an agent or affiliated broker can sue the mothership in this type of situation. The typical broker / affiliate agreements don't include a non-compete clause. However, what Pru did was not acceptable behavior (in my humble opinion).

Let me see if I can put a fine point on this!

Let's say I am PAS broker. I've done the BPOs, sold the REOs and done the Default School thing. I am also associated with Prudential.

Prudential and PAS sign an agreement and suddenly I'm out in the cold. My prior business relationship with PAS means jack. I cannot be assured by the RELO group that I will get any further listings from PAS but if I do, I will now pay a referral fee to PRU (on top of the franchise fee, marketing fees and all the rest). I cannot have a relationship with the AM because all email is sent to a centralized email account, where someone decides if I see it or not.

Do you know what I call that? I call it intentional interference of a business relationship (since we're all independent contractors and work for ourselves) which is actionable (meaning you can sue). I can see a lawsuit being filed and Pru losing it's arse.

It's not much better with ReMax or C21 either.

Well heard this one then! I tried to be accepted since the end of 2006 to get in with PAS/WF and nothing until a month and half ago, when one of my AMC's(cannot mention name)call me and said that I've been chosen to take part of a new business venture within them and PAS. I got the call from the main owner himself and today I got my approval and login info and am in.

However, I have to share a high commission can't discuss numbers but am happy that I got the account.

But I can. In my area there is a large regional independent that got a similar deal with PAS. I used to work there and know some people who are still there. Their model is based on the Relo model and the mother company takes 30% off the top. Then the agent gets their normal split after that. So somebody on a 70% split would get 49% for an REO (or Relo) sale.

In my opinion, this creates a disincentive to give good service to the REO clients. But hey, it's just my opinion and I could be wrong.

Hahaha Pine it is so true. Yeah the breakdown on the commission is a killer hope to get the volume to compensate the horrible nights doing the dirty work for the clients(banks)

I mainly do commercial and PAS is the residential arm for Wells Fargo.

They have had the not accepting new agents for what 3 years now?

They accepted me the last part of the year in 2007. 2 months later my broker associate tried to join and they weren't accepting.

Put it this way! I didn't get directly with them and I've trying since 06, but this AMC has strong ties with several big players like Chase, WF, FNMAE, Saxxon, Aurora, and the extincted Wamu. Counting the days for the first assignment but they are very strict in their valuations and PP.
