Hello. I listed my property with a broker on February 1st. The property is on the service road of I-35 in Oklahoma and is zoned Commercial C-3. The property also has a house on it.

The agent received confirmation of the property's zoning on Feb. 18th. I have now asked the agent in writing 3 times to place a commercial rider on the sign. She keeps giving me excuses for why it is not done. This commercial property has been listed for 2 full months now with no commercial rider or sign. It is on the service road of a major interstate! No one knows it is commercial. It appears to be just a residential house.

There are some developers trying to build an upscale housing area a couple of blocks from the property. Most of the residential houses in the area are worth $50-85k. However, this new addition would increase the values. Some of the residents don't want it to go through saying that the new houses would bring down their values siting my property, which is listed at $135k as an example. They are going to city council meetings saying that their residential properties are worth as much as mine because there is no way for them to know mine is supposed to be listed as commercial. This is creating A LOT of problems in my community.

What are my rights if she just won't do her duties despite it being 2 months and me asking in writing 3 times?

I would contact her broker or the manager of her office. Let them know about the situation and you might get some results. Good luck.

Did you sign a commercial listing contract or a residential listing contract? Does the listing show the correct zoning classification and is it listed in the Commercial version of MLS and most important is it listed on Loopnet?

Despending on the answers to these questions you maybe be able to demand the release of the listing agreement since the agent may not be doing what they agreed to in the contract. Tell the broker that you plan to file a complaint with both the local Realtor board if she is a member or with the state real estate commission if not. If you can get the broker to release the lising then relist it with a Full-Time Commercial only agent instead of a residential agent that just dabbles in commercial!

The property is listed on Loopnet and the commercial section of MLS. She stated that it would be a commercial listing. However, the listing agreement is the standard residential one. The listing agreement does not show the zoning on it.

She told me she did a lot of commercial listings. Apparently, she lied.

If this property has Interstate visibility and only has a small residential for sale sign without a commercial rider then your broker is CHEAP and does not want to pay for the large commercial signs. Those signs are very expensive but you have to have them and obviously she does not.


Tell your broker that you expect that large Commercial sign to be up withing 7 days or you want to be released from the listing agreement immediately so you can list with a professional commercial agent!

Also call the local board and ask if a commercial property must be listed witha commercial listing contract?

When you signed the listing contract, was there anything that spelled out about signage?
I would think if the broker refuses to use the appropriate signage, you could ask for a release from the listing agreement. If the broker refuses to release you, and you refuse to use their services, couldn't the client do this based on the broker's non-performance?
