I have a situation with failed window thermal seals. There is condensation between the panes of glass. The inspector noted it on the report and now my buyer client wants this repaired. The seller is refusing. Do you consider this a cosmetic thing or a functional thing? At the inspection, the inspector said something about my clients losing effeciency, but I didn't think windows were very effecient in the first place. Thanks for the help.

That is something that should have been seen viewing the home. This is not an issue that affects the habitability of the home so in my area it would be a non issue. In my area the way it works is the buyer saw the windows upon viewing the home and did not ask for repair in the purchase contract so if the seller feels like it they may repair them.

This was my thought on it also. However it's another thing trying to convince your buyer that it's only cosmetic.

Depending on the temperature and humidity, condensation is not something permanent. You really have to look close sometimes to notice it, at other times, you might as well think you are looking at the wall.
Good Inspectors will catch these things during the inspection, and the buyer has every right to ask for replacement, cosmetic or not.
My seller just replaced 11 huge double window panes, all for $1k, it's really not that expensive and for a seller to take a chance of losing a buyer in todays market over something like that is silly IMHO.

Well...They asked for it to be replaced, but the seller refused.

If the buyer does not walk, it's ok. I hope everyone knows and makes an educated decision based on the cost involved and not just because....

In my area... The windows are not "functioning as intended" and must be replaced at the sellers expense.

In my area, a seller does not HAVE TO do any repairs if they don't want to. All inspection repair items are negotiable between buyer and seller.

Obviously the seller doesn't 'have to'. But part of the negotiating process is to identify what,if any deficiencies, and who 'owns' them.

In many cases it would be in the best interests of the buyer if they corrected shortfalls themselves, to thier liking, and negotiate that value into the sale price.

An obstenant seller may 'have to' if the house goes unsold due to a denied 'defect'.

Window seal failure is more of a cosmetic issue than anything. It really won't affect the efficiency of the glass pack unless it had gas in it (such as Argon). The glass packs can be easily removed and replaced by a glass shop. This is a low cost repair and should not be a deal breaker.

The owner may be more willing to have the glass pack replaced if they knew the replacement costs. I have found that many times deals can fall apart simply because people are uninformed.
