What do you guys think of the forms used by First Tuesday? Are they similar to winforms? I am looking into an alternative in costs which can give me the forms necessary for the business. Thanks in advance.

Hmmm.... there are a couple of real estate form options out there.

Frankly, I would just stick with what your association provides (IE: WinForms).

I know that in Santa Clara County, there is a pretty good following for PRDS contracts (http://www.prdsforms.com/), which were endorsed by the Santa Clara Association of Realtors - members of that board got access as part of their membership until June of last year - the association did not renew it. San Mateo County has the same deal - and has continued their membership. The silicon valley assocation has also continued its relationship with the PRDS people.

I still have my membership with the Santa Cruz Association, so I have been sticking with winforms.

I have noticed on many listings in Santa Clara County, the listing will specifically stipulate PRDS forms. However, I have never used a PRDS form and have never had it be an issue. On the phone I have had some say they will not consider an offer written on any other form - but in practice this has always been a hollow threat. I will usually simply tell the other agent that if they feel so strongly about the issue, please feel free to include in a counter-offer the provisions they find so critical in the PRDS forms. I have never had an agent actually do this however.

Go with what is the most common practice in the area you do business. No sense in making a deal more complicated by using a form few have seen before.
