Good comment J. Thanks for the post. The full text of the law is an interesting read. What seems to get more of the spammers isn't technical violations in the email. It's more often where the email addresses came from. Almost all of the commercial online drip email services are paranoid about requiring "opt-in" before allowing names on your list. Paying for the addresses, etc. can mean that, somewhere in the chain to you, there was a gathering mechanism that violates the canspam act...hence the mention of "affirmative consent" multiple times in the act.
Here's a quote from the ftc.gov site: "You can forward spam directly to the Commission at spam@uce.gov without using the complaint form."
