I have a question.

I am going to be a licensed personal assistant and have been asked to sign a contract. Most of the contract I am perfectly okay with.

There is one section though that I don't understand. I am going to be the co-list agent on any deals I work with for them on their behalf.

But any leads I bring in on my own - family, friends, etc...that have nothing to do with the office...but are solely from my "SOI" - they are requiring that I "co-list" with them (though I will get the full commission of "my own" deals).

I just don't understand why I am being asked to colist any of my own personal deals.

Only a guess but it could be office policy because the broker wants to make sure there is someone else responsible for the listing to keep it covered if you are away or incapacitated.

It is most likely that as a licensed assistant you are actually that agents or brokers employee reagrdless of how you get paid. That agent is responsible for all your actions. Since you are getting your full commission split for any listing you bring in you should not care if there is a co-listing agent listed in MLS as it does not effect your commission.

Well, I DO care about something I don't understand.

I am an employee rather than an independent contractor. I do know that all of your listings and sales are "tracked". In PA, you not only need to have been in sales for 3 years in order to become a broker, but you also have to accumulate a certain number of points (transactions - listings and sales) as well. Will I not get full credit for something if it's a co-list?

(yes, the idea of being a broker in the future appeals to me a great deal. I do not want to be someone's employee, or work under someone else's authority, for the rest of my life.)

So, yeah. I DO care. I will not have a chance to ask my broker about this for a few days and was looking for some insights here.

Hmm. I don't think so. I'm the most constant fixture in that office....I put in more hours at the office than anyone except the bosses. LOL.

It all comes down to you are an Employee and that agent is Responsible for you and what you do and that is the reason for the co-list! It is just that simple and yes normally a each listing agent gets a credit for the listing at least in our MLS system.

It's not an just an agent, it's the broker/owner. I will be the broker's assistant. The broker is responsible for everyone in the office but I will be the only one required to co-list.

As long as I can still get my credits then I guess I have nothing to be concerned about.

I've never worked in an office where a licensed assistant was allowed to co-list at all. I don't know if it was a Colorado thing or just an office policy, but my understanding was that a licensed assistant is not required to pay all the fees and comply with all the requirements of an agent, so they are not entitled to have their own "business." Everything they do is to be done under the name (and liability) of their agent.

Might be different where you are...

I asked about that today - I think because they are goign to let me list and sell things to my personal friends/family/SOI that has nothing to do with the office, I have to join the MLS as a full member.

If I were going to be strictly and only their licensed personal assistant, I could probably avoid all that.

I was hoping I could avoid the fees/dues for now but my broker said that I will have to join if I am going to be listing and selling my own stuff. It's just that I'll have to list it as a co-list with them but retain full commission. (I still don't get it really, but as long as I can get credit for it, I'm not gonna get all in a tizzy over it.) LOL

I just like to understand things, ya know? :p
