close of escrow date has past, buyers didnt sign addendum to extend escrow yet. Is seller entitled to keep emd.? Isnt buyers in default if they don;t close on time?? Still waiting for loan docs. lender keeps saying they have everything but still waiting for loan docs. thanks

This sounds a little nuts.

The escrow did not close because your buyers loan did not come through .... and the BUYERS did not sign the escrow extension?!?!??! Did the sellers?

What the hell is wrong with your buyers? Why on earth would they not sign the extension in a timely fashion?

In most cases, stuff like this works out. The sellers want to sell and the buyers want to buy so everyone just waits for the bank to work their magic... whether the set date is met or not.

However, in this case, if the worst happens, your buyers are out their deposit.

So your buyers signed off on everything and all contingencies have been signed off? We are just waiting on the final papers for signing on the loan?
