I know of an agent in my area that does one every six weeks (she has like 3 or 4 people working for her) with a map, a little description and prices on one side and on the other, I believe it's something on the lines of 'call me'. It is definatley sleasly and I would consider it unethical if you didn't personally list or sell it.

Well I guess agents can just send out a newsletter or something with the recent solds in the neighborhood...like a short CMA.

I forget to add that the way it is designed makes it look like she sold everything.

But, I guess it would be ok to send out something quarterly stating the recent solds, what the homes are selling for, and mention if anyone is interested in selling their home to call you. I was reading the code of ethics, and it just states that you can't say you sold it when you werent involved in the transaction. It also says to be clear and not mislead the public.

We receive a lot of "just sold" cards from agents who didn't sell the property, as well as "market trend" newsletters, etc. As long as you don't mislead the public, as you said, it's perfectly fine...you're not advertising you sold anything, you're providing information while keeping your name in front of prospective clients.
My first mailing was a "it's okay to be a nosy neighbor" postcard inviting people to sign up on my website for automatic email updates about activity in their neighborhood. This way you get their contact info and they're hearing from you on a regular basis.
I had a 2% response rate to that postcard, which translated into 2 listings that first year. There would have been 3 listings, but I declined the third because I felt the seller was unrealistic and was also planning on getting rid of rental tenants under a false pretense.
Those 2 listings generated additional business, as well, so I'd say it was successful.

The real estate codes in many states address this issue under some kind of "false advertising" category. If the mailer makes it clear that this is a compilation of market activity in a particular area, then it shouldn't be a problem. If it implies that this person or compnay sold all these properties, then it would fall under these false advertising guidelines. When I lived in Florida, one of the large flat fee companies used to send out a monthly newletter that, on it's face, seemed to imply that they sold all of the properties listed in the two zip codes covered in the mailer. Only when you read the very fine print on the back did you find that it was a compilation of all of the sales in these zip codes from the MLS. As a Realtor, I knew what it was. Do you think the general public reads all of the disclaimers on these mailers?
