Just wondering if anyone still farms expired listings and if so how do you do this inspite of privacy issue's. Our board now has the seller check a box on the listing stateing wether they can be contacted or not after the listing runs out.

As far as I know - making contact is a no - no unless you are generally farming to the entire area

I thought contacting expireds was okay as long as the original listing wasn't privacy protected. Does this policy vary from board to board?

When a listing comes out on MLS, the owner's name is listed along with *priv prot* written beside it. We're not allowed to contact them when the listing expires.

I don't know if the rules change if they relist with another realtor and don't privacy protect the 2nd time around. I'll have to find out.

Someone want to check REBBA 2002? Seems to me that mining expired listings is a no-no for sure. It is considered unethical as you are soliciting another agent's customer?

Once the listing has expired AND it is not privacy protected, I can solicit the owners. That's how it is in Vancouver. I can't speak for the TREB.

I'm not trying to be difficult but my understanding is that you can contact expireds unless they are expressly privacy protected.

I read CREA's Privacy Code and I see all the restrictions on disseminating data to 3rd parties but nothing that specifically forbids contacting expireds. If you can show me what I'm missing, I'd be grateful. And I'm not being facetious.

There is no limits/rules that will stop you from doing a business in an area. So include the expired once in the area that you will be working on
