Problem #1) I'm purchasing a house and MLS lists the property lot size is 5,088 sq ft, but I've found the sq. ft. listed on the property profile is 3,049.

Listing agents won't disclose the lot size when asked...who knows why?

Problem #2) I asked the owner if there are Mello Roos Tax and they said "no." Later I found on the Tax Data that there is??? What's up with this?

Problem #3) The property looks like PUD w/ HOA dues. How come the title report states it's a condominium???

I'm just about had it with the selling agents because and owners with the untruthfulness and lack of disclosinging information up front to me.

I'm seriously thinking about canceling this deal because of their immoral ethics? Should I?

What can I do about this?

My agent has been in this business for 20 years and this is his first case in which the listing agent have been most uncooperative to disclose or provide information. They said to my agent "You're a professional agent, you should know all the information."

He is scared that because of this uncooperativeness, the owner's will not fix the "request to repairs" (they signed the form).
But after we fax the contingency removal, it's a final sale...So he suggests that while going through the walk through to be super friendly to the owner's so the rest of the transaction can go smoothly.

It is the responsibility of the buyer and/or buyer's agent to verify all dimensions, zoning, school zoning, and square footage. Whatever a buyer does to verify those things are part of their due diligence period, and if the results aren't satisfactory to the buyer, the contract may be cancelled on that basis. You usually have 14 days or so to complete your due diligence.

If the seller is being that uncooperative, or you have fears about the repairs being done correctly and professionally, just walk away from the home. In Las Vegas, we have more than 20,000 homes listed just in the MLS not counting FSBOs and non-MLS listings. I am sure that you can find a seller that will appreciate your business, find another home!

You can not, however, cancel any contract because you don't end up liking the other party or question their ethics, FYI...
