Yes. Because the broker, not the agent, is the responsible party.

Hmmm, I thought designated agency was intended to prevent a dual-agency situation. Maybe I'm wrong tho. Personally, I won't do dual-agency - but I'll work with a designated agent from my office on a deal all day long.

In MN if two agents work for the same broker that is dual agency. It does not matter if the two agents are in the same office or in different ones. As long as both of the brokers are the same it is. Now I am not sure if this is the same in all states, but that is how it is here.

Now how I explain this to my clients is that although it will be "dual agency" It does not mean that I am representing both parties, it just means that they do work in one of the same offices as me. I may or amy not even know who this person is. Most time the clients are very understanding and okay with it.

I hope that this helps. Good luck

Amanda

You need to find out what kind of agency your office works under. If you are consensual dual agency, then if any agent from your company brings a buyer, that is dual. If you are a designated agency office, the only condition in which you have dual agency is if YOU bring the buyer (already being the listing agent).
